EU and U.S. Data Sharing—Can Tensions Be Resolved? presented at IAPPEuDPC 2014

by Harriet Pearson, Vivienne Artz, Simon Mcdougall,

Summary : Due to the breadth of the topic, we will focus on the EU—including the latest stance under the draft regulation on international transfers—and the status of Safe Harbor—and its limitations—against specific issues. We’ll explore the ongoing Microsoft search warrant case, the pressures from FATCA, how firms are addressing these extraterritoriality pressures in practice and, finally, how these “for” and “against” pressures for data sharing line up with the EU/U.S. trade discussions and arrangements, particularly if this uncertainty continues.
